Our Windsocks & Accessories have been tried and tested in the harshest Australian conditions over many years and it is in our interest to make sure that they last.
We warrant all of our Products as described in this policy. This warranty excludes faults or failures caused by improper use and abuse; fair wear and tear; or failure to follow instructions regarding care and maintenance.
Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Warranty Terms - Windsocks
We warrant that all Windsocks will be free from defective materials and workmanship under normal and intended use, subject to the conditions below for a period of 12 months. We will repair or replace at our sole discretion any Windsock products found to be defective in material and workmanship in the relevant warranty period so long as the Warranty Conditions are satisfied.
Warranty Terms - Other Products
We warrant that other products (frames, poles, mounting brackets) supplied by Us will be free from defective materials and workmanship under normal and intended use, subject to the conditions below for the periods described in the relevant product Datasheet.
Warranty Conditions
The warranty is subject to the following conditions and limitations:
- The warranty is applicable to all products supplied by Us;
- The warranty is void and inapplicable if:
- The products have been used or handled other than in accordance with instructions provided by Us which includes the taking down of the Windsocks prior to dust storms, cyclones, and other extreme weather conditions which is accepted practice in the preservation of a Windsock assemblies life;
- The product has been deliberately abused, or misused, damaged by accident or neglect or in being transported; or
- The defect is due to the product being repaired or tampered with by anyone other than Us or Our authorised repair personnel.
- The customer must give Us notice of any defect with the product within 30 days of the customer becoming aware of the defect;
- No modifications to the original specifications determined by Us shall be made without Our written approval;
- The product must be packed and returned to Us by the customer at his or her sole expense. On receipt of the product We will access the product and advise the customer as to whether the claimed defect is covered by this warranty;
- We reserve the right to modify the design of any product without obligation to purchasers of previously manufactured products and to change the prices or specifications of any product without notice or obligation to any person;
- This warranty does not cover any damage or defect caused to any product as a result of any acts of nature;
- There are no representations or warranties of any kind by Us or any other person who is an agent, employee or other representative or affiliate of Ours, express or implied, with respect to condition or performance of any product, their merchantability, or fitness for a particular purpose, or with respect to any other matter relating to any products.
Limitation of Liability
To the extent permitted, Our liability under this Warranty will, at Our option be limited either to the replacement or repair of any defective product covered by this warranty. We will not be liable to the Buyer for consequential damages resulting from any defect or deficiencies in accepted items.
Apart from the specific warranties provided under this Warranty, all other express or implied warranties relating to the above product are hereby excluded to the fullest extent allowable under law. The warranty does not extend to any lost profits, loss of goodwill, or injury, or any indirect, incidental or consequential costs or damages or losses incurred by the purchaser as a result of any defect with the covered products.
